    Doctrine of Eclipse

    • The doctrine states that if any law becomes contradictory to the fundamental rights, then it does not permanently die but becomes inactive.
    • As soon as that fundamental right is omitted from the Constitution, the inactive law becomes revived.
    • When a court strikes a part of the law, it becomes unenforceable. Hence, an ‘eclipse’ is said to be cast on it. The law just becomes invalid but continues to exist.
    • The eclipse is removed when another (probably a higher level court) makes the law valid again or an amendment is brought to it by way of legislation.
    • Supreme Court first applied this doctrine in the case of Bhikaji vs State of Madhya Pradesh where it applied to pre-constitutional law. The extension to the post-constitutional law was stated in the case of Dulare Lodh vs ADJ Kanpur.

    जलसन्धि (Strait) – पानी के ऐसे संकरे रास्ते को जो दो बड़े जल के समूहों को जोड़ता हो और उसमें से नौकायें निकलकर एक बड़े जलाशय से दूसरे बड़े जलाशय में आ-जा सकें, को जलसंधि या जलसंयोगी या जलडमरू कहते हैं। अधिकतर इसका भौगोलिक आकार डमरू की तरह होता है, जिसके दो बड़े भागों के मध्य जलसंधि होती है, इसीलिए इसे जलडमरूमध्य भी कहते हैं। कुछ प्रमुख जलसन्धि जैसे- मलक्का, पाक, जिब्राल्टर, यूकाटन, कुक, मैगलन आदि ।

    भूमिका
    प्रवर्तन निदेशालय एक बहु अनुशासनात्मक संगठन है जो वित्त मंत्रालय के राजस्व विभाग का हिस्सा है। यह दो विशेष राजकोषीय कानूनों – विदेशी मुद्रा प्रबंधन अधिनियम, 1999 (फेमा) और धन की रोकथाम अधिनियम, 2002 (पी.एम.एल.ए.) के प्रावधानों को लागू करने का कार्य करता है। सीधी भर्ती द्वारा कर्मियों की नियुक्ति के अलावा निदेशालय प्रतिनियुक्ति पर विभिन्न जाँच एजेंसियों, सीमा शुल्क और केंद्रीय उत्पाद शुल्क, आयकर, पुलिस आदि विभागों से भी अधिकारियों को नियुक्त करता है।

    अधिकार एवं शक्तियाँ
    एक बहुआयामी संगठन की भूमिका में निदेशालय दो कानूनों को लागू करता है, जो निम्नलिखित हैं:

    1. विदेशी मुद्रा प्रबंधन अधिनियम – यह एक नागरिक कानून है, जो निदेशालय को अर्ध न्यायिक शक्तियाँ देता है।
    यह निदेशालय को विनिमय नियंत्रण कानून के संदिग्ध उल्लंघनों की जाँच करने के साथ दोषी पर जुर्माना लगाने की भी शक्ति देता है।

    2. धन शोधन निवारण अधिनियम – यह एक आपराधिक कानून है, जो निदेशालय के अधिकारियों को अनंतिम रूप से जाँच पड़ताल करने, पूछताछ करने और जुर्माना लगाने का अधिकार देता है।
    यह कानून अधिकारियों को कालाधन के कारोबार में लिप्त व्यक्तियों को गिरफ्तार करने और मुकदमा चलाने के अलावा अपराधिक कृत्यों से प्राप्त संपत्ति को संलग्न/जब्त करने का अधिकार भी देता है।

    निदेशालय के मुख्य कार्य इस प्रकार हैं:

    • विदेशी मुद्रा प्रबंधन अधिनियम, 1999 (फेमा) के प्रावधानों के उल्लंघन की जाँच करना, जो 1.6.2000 से प्रभाव में आया।

    • निदेशालय नामित अधिकारियों द्वारा फेमा के उल्लंघन के दोषियों की जाँच की जाती है और इसमें शामिल राशि का तीन गुना तक जुर्माना लगाया जा सकता है।
    मनी लॉन्ड्रिंग निरोधक अधिनियम, 2002 (PMLA) के प्रावधानों के तहत (जो 1.7.2005 से प्रभावी हुआ) धन शोधन के अपराधों की जाँच करना, संपत्ति की कुर्की और जब्ती की कार्रवाई करना और मनी लॉन्ड्रिंग के अपराध में शामिल व्यक्तियों के खिलाफ मुकदमा चलाना (28 कानूनों के तहत 156 अपराध हैं, जो पी.एम.एल.ए. के तहत अनुसूचित अपराध हैं।)

    • निरस्त विदेशी मुद्रा विनियमन अधिनियम, 1973 (FERA) का (31.5.2002 तक के) उल्लंघन होने पर जारी किये गए शो कॉज नोटिस (कारण बताओ नोटिस) का न्याय निर्णयन करना, जिसके परिणामस्वरूप जुर्माना लगाया जा सकता है।
    भगोड़े आर्थिक अपराधी अधिनियम, 2018 के तहत भारत से भागे लोगों के मामले देखना।
    • इस अधिनियम का उद्देश्य ऐसे भगोड़े आर्थिक अपराधियों को दंडित करना है जो भारतीय न्यायालयों के अधिकार क्षेत्र से बाहर रहकर कानून की प्रक्रिया से बचने के उपाय खोजते हैं।
    • FEMA के उल्लंघन के संबंध में विदेशी मुद्रा और संरक्षण गतिविधियों की रोकथाम अधिनियम, 1974 (COFEPOSA) के तहत निवारक निरोध के प्रायोजक मामले देखना।
    • पी.एम.एल.ए. के प्रावधानों के तहत मनी लॉन्ड्रिंग (धन शोधन) और परिसंपत्तियों की बहाली से संबंधित मामलों में अन्य देशों को सहयोग प्रदान करना और ऐसे मामलों में सहयोग लेना।
    प्रवर्तन निदेशालय द्वारा कुछ नियम,कानून और अधिनियमों का प्रयोग किया जाता है, जिनका उल्लंघन होने पर यह निदेशालय सक्रिय हो जाता है –

  • AUKUS

    The U.S. has joined with the U.K. and Australia to announce a new trilateral security partnership, the AUKUS.

    Significance of AUKUS:

    • AUKUS aims to ensure that there will be freedom and openness in the Indo-Pacific region, including the South China Sea.
    • It complements several pre-existing similar arrangements for the region like Five Eyes intelligence cooperation initiative, ASEAN and the Quad
    • It proposes to transfer technology to build a fleet of nuclear-powered submarines for Australia within 18 month.
    • US has clarified that AUKUS was “not talking about nuclear-armed submarines. These are conventionally armed submarines that are powered by nuclear reactors.
    • Although no explicit mention was made of China in any of the AUKUS announcements, this group challenges the regional hegemonic ambitions of China.
    • The operationalisation of this security partnership lead to closer coordination among the nations concerned in terms of joint military presence, war games and more in the region.

    Concerns

    • Australia’s domestic challenges: As per Australia’s 1984 nuclear-free zone policy, nuclear-powered submarines would not be allowed into the former’s territorial waters. Hence, there is a political opposition to it.
    • Upset France: Australia had struck a deal with France for $90 billion worth of conventional submarines, which stands cancelled now. This has upset political leadership in France
    • Battleground: The Indo-Pacific region will emerge as the new geopolitical battle ground posing greater security risk to others.

    Doctrine of Pith and Substance

    • Pith and substance is a legal doctrine used to determine under which head of power a given piece of legislation falls. The doctrine is primarily used when a law is challenged on the basis that one level of government (be it provincial or federal) has encroached upon the exclusive jurisdiction of another level of government.
    • According to this doctrine, it is examined to check its“true nature and character” in order to ascertain in what list it falls.
    • It provides a degree of flexibility. It is widely used in determining whether the state is within its power to make a statute that involves a subject mentioned in the union list of the constitution.
    • It is applied in the case State of Bombay Vs F.N Balasar, by the supreme court. This was the first important judgment that upheld the pith and substance.
  • मध्य प्रदेश में पंचायती राज

    मध्य प्रदेश में पंचायती राज

    1 नवम्बर, 1956 के पूर्व म.प्र. की तीन इकाइयों, यथा-मध्य भारत, विन्ध्य प्रदेश व महाकौशल में अलग-अलग पंचायती राज व्यवस्था कायम थी। राज्य बनने के बाद इस व्यवस्था का एकीकरण भी जरूरी हो गया था, जिसके लिए वर्ष 1962 में प्रथम बार म.प्र. पंचायत अधिनियम लागू किया गया। इसके अंतर्गत 1965 में चुनाव भी सम्पन्न कराए गए परन्तु जनपद पंचायत का चुनाव अधिनियम लागू किया गया। इसके अंतर्गत 1965 में चुनाव भी सम्पन कराए गए परन्तु जनपद पंचायत का चुनाव पहली बार 1971 में हो सका। वर्ष 1981 में प्रदेश सरकार द्वारा म.प्र. पंचायती राज अधिनियम के रूप में स्वीकृत हुआ। इसके अंतर्गत राज्य में त्रिस्तरीय पंचायती राज व्यवस्था जारी रखने की बात स्वीकार की गई। संविधान के 73वें संशोधन के अनुसार पुनः 29 दिसम्बर, 1993 को राज्य विधानसभा में म.प्र. पंचायती राज अधिनियम विधेयक प्रस्तुत किया गया जिसे विधानसभा द्वारा 30 दिसम्बर, 1993 को पारित कर दिया गया। तत्पश्चात् पंचायतों व नगरीय प्रशासन का चुनाव सम्पन कराने के लिए 19 जनवरी, 1994 को म.प्र. राज्य निर्वाचन आयोग का गठन किया गया। म.प्र. राज्य निर्वाचन आयोग के प्रथम आयुक्त श्री एन.वी. लोहानी थे। इस निर्वाचन आयोग के द्वारा 15 अप्रैल, 1994 को पंचायतों के चुनाव संबंधी अधिसूचना जारी कर दी गई। इस प्रकार इस राज्य ने देश में नई संवैधानिक व्यवस्था के आधार पर त्रिस्तरीय पंचायतों व नगर प्रशासनों के चुनाव कराने वाला देश में प्रथम राज्य होने का गौरव प्राप्त किया।

    त्रिस्तरीय पंचायत
    वर्तमान समय में राज्य में त्रिस्तरीय पंचायती राज व्यवस्था कायम है, जिनकी अवधारणा में एक या एक से अधिक गांवों के लिए  जिला पंचायतों की बात शामिल है। 1993 के अधिनियम में संविधान में त्रिस्तरीय पंचायतों के प्रमुखों के निर्वाचन की स्थिति के संदर्भ में यह व्यवस्था की गई है  केवल ग्राम पंचायतों के सरपंच के मामले में निर्वाचन प्रक्रिया का जिम्मा राज्य सरकार के विवेक पर निर्भर करेगा जबकि जनपद एवं जिला पंचायतों के मामले में सदस्यों का चुनाव प्रत्यक्ष मतदान प्रणाली के माध्यम से चुने हुए सदस्यों द्वारा किया जाएगा।

    Initiatives Taken for Adopting Green Hydrogen

    • The Indian Railways have recently announced the country’s first experiment of a hydrogen-fuel cell technology-based train by retrofitting an existing diesel engine.
    • The Union Budget (2021-22) has announced a National Hydrogen Energy Mission (NHM) for using hydrogen as an energy source.
    • Saudi Arabia is also prioritising plans to manufacture renewable energy by utilising ‘idle-land-banks’ for solar and wind energy generation.
    • It is working to establish a mega $5 billion green hydrogen manufacturing unit covering a land-size as large as that of Belgium, in the northern-western part of the country.
    • In the Asia-Pacific sub-continent, Japan and South Korea are on the front foot in terms of hydrogen policy making.
    • Japan’s Basic Hydrogen Strategy sets out the country’s action plan till 2030, including the establishment of an international supply chain.

    Importance of Speaker’s Independence

    • Supreme Authority: In the Lok Sabha the Speaker is the supreme authority. He has vast powers, and it is his primary duty to ensure the orderly conduct of the business of the House.
    • Symbol of Nation’s Freedom: Jawaharlal Nehru referred to the Speaker as “the symbol of the nation’s freedom and liberty” and emphasised that Speakers should be men of “outstanding ability and impartiality”.
    • Guardian of the House: MN Kaul and SL Shakdher referred to the speaker as the conscience and guardian of the House.
    • As the principal spokesperson of the Lok Sabha, the Speaker represents its collective voice.

    Roles and Responsibility of Speaker

    • It is the Speaker’s duty to decide what issues will be taken up for discussion.
    • Interpretation: He/She is the final interpreter of the provisions of the Constitution of India, the Rules of Procedure and Conduct of Business of Lok Sabha and the parliamentary precedents, within the House.
    • Joint Sitting of Both Houses: He/She presides over a joint sitting of the two Houses of Parliament.
    • Adjournment Motion: He has the sole discretion to permit an adjournment motion to be tabled or to admit a calling attention notice, if the issue is of urgent public importance.
    • Money Bill: He/She decides whether a bill is a money bill or not, and his/her decision on this question is final.
    • Disqualifying Members: It is the speaker who decides the questions of disqualification of a member of the Lok Sabha, arising on the ground of defection under the provisions of the Tenth Schedule.
    • Constitution of Committees: The Committees of the House are constituted by the speaker and function under the speaker’s overall direction.
    • The Chairmen of all Parliamentary Committees are nominated by him/her.

    Education System of India (History)

    In the Beginning, in ancient times, India had the Gurukula system of education in which anyone who wished to study went to a teacher’s (Guru) house and requested to be taught. If accepted as a student by the guru, he would then stay at the guru’s place and help in all activities at home. This not only created a strong tie between the teacher and the student, but also taught the student everything about running a house. The guru taught everything the child wanted to learn, from Sanskrit to the holy scriptures and from Mathematics to Metaphysics. The student stayed as long as she wished or until the guru felt that he had taught everything he could teach. All learning was closely linked to nature and to life, and not confined to memorizing some information.

    The modern school system was brought to India, including the English language, originally by Lord Thomas Babington Macaulay in the 1830s. The curriculum was confined to “modern” subjects such as science and mathematics, and subjects like metaphysics and philosophy were considered unnecessary. Teaching was confined to classrooms and the link with nature was broken, as also the close relationship between the teacher and the student.

    Universal and compulsory education for all children in the age group of 6-14 was a cherished dream of the new government of the Republic of India. This is evident from the fact that it is incorporated as a directive policy in article 45 of the constitution. But this objective remains far away even more than half a century later. However, in the recent past, the government appears to have taken a serious note of this lapse and has made primary education a Fundamental Right of every Indian citizen. The pressures of economic growth and the acute scarcity of skilled and trained manpower must certainly have played a role to make the government take such a step. The expenditure by the Government of India on school education in recent years comes to around 3% of the GDP, which is recognized to be very low.

    The School System

    India is divided into 28 states and 8 so-called “Union Territories”. The states have their own elected governments while the Union Territories are ruled directly by the Government of India, with the President of India appointing an administrator for each Union Territory. As per the constitution of India, school education was originally a state subject —that is, the states had complete authority on deciding policies and implementing them. The role of the Government of India (GOI) was limited to coordination and deciding on the standards of higher education. This was changed with a constitutional amendment in 1976 so that education now comes in the so-called concurrent list. That is, school education policies and programmes are suggested at the national level by the GOI though the state governments have a lot of freedom in implementing programmes. Policies are announced at the national level periodically. The Central Advisory Board of Education (CABE), set up in 1935, continues to play a lead role in the evolution and monitoring of educational policies and programmes.

    Importance of Education in Social Development of the Women

    • Higher Social Return: The global average for the private rate of return (the increase in an individual’s earnings) with just one extra year of schooling is about 9%, while the social returns of an extra year of school are even higher — above 10% at the secondary and higher education levels as per a decennial World Bank review.
    • Positive Impact of Higher Education: Interestingly, the private returns for women in higher education are much higher than for men — 11 to 17% as per different estimates.
    • This has clear policy implications. For their own empowerment, as well as for society at large, we must bring more and more women within the ambit of higher education.
    • Women Can Play Leadership Roles: Healthy, educated girls with equal access to opportunities can grow into strong, smart women who can take on leadership roles in their countries. This will help in having a better view of women’s perspective in the government policies.
    • Poverty Alleviation: Women constitute almost half of the country’s population, therefore improving their condition in the country can immensely contribute to poverty alleviation.
    • Women’s empowerment plays a catalytic role towards the achievement of transformational economic, political and social changes required for sustainable development.
